Terms of Use

1. Scope

These Terms of Use govern your use of the Percy mobile app (the “App”), provided by Elias Piersig, Limmattalstrasse 244, 8049 Zürich, Switzerland (“we”, “us”). By downloading or using the App, you agree to these terms.

2. The service

Percy teaches the fundamentals of personal finance and investing through short, interactive lessons, quizzes, financial calculators and a glossary. The App also offers motivational features such as experience points, streaks and optional reminders.

The App is free to use and is financed by advertising shown within the App. If paid features are offered in the future, you will be clearly informed before any purchase.

No account is required. Your learning progress is stored only on your device. This means we cannot restore it if you delete the App, switch devices or lose the data in some other way.

3. No financial advice

All content in the App is for general financial education only. It does not constitute investment advice, brokerage, tax or legal advice, or a recommendation to buy or sell any particular financial product. It does not take into account your personal financial situation, goals or risk tolerance.

Calculator results are simplified example calculations based on your inputs. They generally do not account for costs, taxes or fluctuations and are neither a forecast nor a guarantee of future performance. All investments carry risk, up to and including the total loss of the money invested. Past performance is not a reliable indicator of future results. For personal decisions, please consult a qualified professional.

Advertisements shown in the App come from third parties. They are not recommendations from us, and we are not responsible for the advertised products or services.

4. Using the app

We grant you a simple, non-transferable right to use the App for private, non-commercial purposes. In particular, you may not:

• copy, distribute, make publicly available or sell the App or its content,
• decompile or modify the App or circumvent technical protection measures, except where expressly permitted by law,
• misuse the feedback feature, for example for spam or offensive or unlawful content.

5. Intellectual property

All content in the App, including texts, exercises, graphics, the Percy character and the design, is protected by copyright and belongs to us or our licensors. You may only use it within the scope of these terms.

6. Feedback

After a lesson, you can choose to send us an anonymous rating with an optional comment. By sending it, you allow us to use your feedback free of charge to improve the App. Please don’t include any personal data. Details on how it is processed are in our Privacy Policy.

7. Availability and changes

We are continuously developing Percy. We may add, change or remove content and features where this is reasonable for you, for example to update content, fix errors or comply with legal requirements. There is no entitlement to specific content or to uninterrupted availability.

We may amend these Terms of Use with effect for the future. We will let you know about material changes in an appropriate way, for example in the App or on this website.

8. Liability

We create all content with great care, but we cannot guarantee that it is correct, complete or up to date. You are responsible for any decisions you make based on it.

The App is provided free of charge. To the extent permitted by law, we exclude liability for slight negligence. We remain fully liable for intent and gross negligence, for injury to life, body or health, and wherever liability cannot be limited under mandatory law, including product liability law.

9. App store terms

If you obtain Percy through Apple’s App Store or Google Play, the respective platform’s terms of use also apply, for Apple in particular the Licensed Application End User License Agreement (EULA). Apple and Google are not parties to these Terms of Use and are not responsible for the App or its content.

10. Final provisions

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zürich, Switzerland. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside, or of your right to bring proceedings there.

If any provision of these Terms of Use is invalid, the remaining provisions remain unaffected.
